Willem C. Vis International Commercial Arbitration Moot 2019-2020. Task for the BSU team trials. Deadline – September 16, 2019. Date for oral presentation – September 24, 2019

The main task of the trials is based on the case, which was considered at the 25th Willem C. Vis International Commercial Arbitration Moot in 2018 (Problem).

The Problem tells about a dispute between Delicatesy Whole Foods Sp (Claimant) and Comestibles Finos Ltd (Respondent) related to a contract on sale of chocolate cakes.

The Problem is available on the official website of the Vis Moot.

Upon analysing the Problem and relevant sources, you shall prepare the following tasks:

  1. Write a short memorandum on behalf of the Respondent on the issue defined in paragraph 3 (i) (a) on page 48 of the Problem, which shall be limited to the following question:

Should the Arbitral Tribunal decide on the challenge of Mr. Prasad and if so with or without his participation?”.

Please focus your memoranda exclusively on the issue mentioned above. Do not refer to any other aspects of the Problem.

The memorandum shall be prepared in the English language. The requirements to the memorandum are the same as specified on the Vis Moot official website. In addition, the memorandum shall not exceed 5 A4 pages with standard margins, font Times New Roman 12, 1.5 interval.

  1. Oral presentation before the Tribunal concerning the mentioned issue.

The presentation will comprise a speech, which shall not last longer than 5 minutes, and responses to the arbitrator’s questions. The amount and time limit for questions is not established.

The deadline for submitting the memoranda is 16th September, 24:00. The memoranda shall be sent with a cover email enclosed with a brief CV containing the following information:

  • name, patronymic name, and surname;
  • contact details (email and phone number);
  • age;
  • your status at BSU (faculty, education form, grade, specialty, course, group);
  • information about professional practical experiences: internships, employment, etc. Please provide the full list of practice records specifying the place and term of practice, your position;
  • information about courses, programs or studies in foreign educational institutions (please, indicate place, term and specialty);
  • information about your previous participation in other similar student competitions (moot courts, olympiads, UN models, etc.).

The provided memoranda will be reviewed and assessed before the hearing rounds. Preliminary date for the oral presentation shall be 24th September. The place will be informed to you additionally.

Both mentioned stages ate mandatory for all candidates. The total scoring and final decision on the team members will be made after the oral rounds and sent to you via email.
